§ 4-35. Prohibitions.

  • (a)

    No holder of a license authorizing the sale of alcoholic beverages at retail nor any agent or employee of the licensee shall:

    (1)

    Knowingly sell, provide or furnish alcoholic beverages or wine to a minor as defined by state law.

    (2)

    Knowingly sell, provide or furnish alcoholic beverages to any person who is in a state of noticeable intoxication.

    (3)

    Knowingly sell, or permit the consumption of, alcoholic beverages on any day or at any hour when the sale or consumption is prohibited by this article or state law.

    (b)

    If conduct is not otherwise prohibited pursuant to subsection (c) of this section, nothing contained in this section shall be construed to prohibit any person under 21 years of age from:

    (1)

    Dispensing, servicing, selling or handling alcoholic beverages as a part of employment in any licensed establishment.

    (2)

    Taking orders for, and having possession of, alcoholic beverages or wine as a part of employment in a licensed establishment.

    (c)

    No licensee under this article shall allow any person under 18 years of age in any establishment to sell, dispense, serve or take orders for malt beverages or wine. This section will not prohibit persons under 18 years of age who are employed in supermarkets, convenience stores, breweries or drugstores from selling or handling malt beverages and wine which are sold for consumption off the premises.

    (d)

    It is prohibited for any person to bring in his own alcoholic beverages (brown bag in any establishment either licensed or unlicensed to service alcoholic beverages.
