§ 36-209. Same—Commercial service.

  • (a)

    In order to obtain a business license, the applicant must show proof that sanitation service has been arranged with the city and appropriate deposits have been paid for the proposed business.

    (b)

    In order to obtain a commercial building permit, the applicant must show proof that sanitation service has been arranged with the city and appropriate deposits have been paid for the proposed construction.

    (c)

    Overloading will be the responsibility of the producer. Any damage to equipment, containers, or trucks owned by the franchisee due to improper loading, overloading, or loading with improper material will be the responsibility of the producer.

    (d)

    Offloading will be the responsibility of the producer. Damage to trees, shrubs, under groundwater lines, sewer lines, gas lines, driveways, pavement, etc., at the construction site will be the responsibility of the producer. No dirt will be hauled.

    (e)

    The franchisee shall provide curbside collection of refuse placed in carts to all commercial units which do not generate sufficient refuse to warrant dumpster or roll-off service. Such curbside service shall be provided at such specific frequency as shall be agreed upon between the city and the producer, and shall be at the rates set forth in the schedule of rates on file with the General Government Administration Department.

    (f)

    The franchisee shall collect refuse placed in dumpsters or roll-offs of all commercial units which generate sufficient refuse to warrant dumpster or roll-off service. The appropriate dumpster or roll-off capacity and the frequency of collection shall be as agreed upon between the city and the producer, and shall be at the rates set forth in the schedule of rates on file with the General Government Administration Department.

    (g)

    The franchisee shall provide dumpsters, roll-offs, and/or carts to commercial units as agreed by the city and the individual producers. Dumpsters or roll-offs shall be placed in an accessible, outside location on a hard (i.e., concrete) surface according to individual agreements. Individual producers shall be responsible for maintaining such surface. The city reserves the right to amend the placement of containers allowing for safe and efficient service by the franchisee.

    (h)

    The franchisee shall provide dumpsters, compactors, roll-offs, and/or 95-gallon carts to commercial subscribers as agreed between the franchisee and the individual commercial subscribers. Dumpsters, compactors or roll-offs shall be placed in accessible, outside locations on a hard (i.e., concrete) surface according to individual agreements. Commercial subscribers shall be responsible for maintaining such surfaces. The city reserves the right to amend the placement of containers allowing for safe, efficient service by the franchisee.

    (i)

    The city shall notify the franchisee on a daily basis of all service requests for extra pickups.
