§ 36-205. Precollection practices.

  • It shall be the duty of the producer to keep all refuse pending collection and disposal as follows:

    (1)

    All refuse shall be placed at the curbside in carts provided by franchisee or in bags. Recyclable items shall be placed at the curbside in bins provided by the franchisee.

    (2)

    Tree branches and heavy brush which will not fit into carts or bags shall be cut in lengths not exceeding four feet in length and stacked in a compact pile on the right-of-way in front of the residence adjoining the curb, but such piles shall not extend into the street. Sticks, hedge clippings and small brush shall be gathered into bundles and tied securely so that each bundle does not exceed four feet in length nor weigh more than 50 pounds. The franchisee will not collect logs and limbs over four inches in diameter or over four feet long. Dead animals weighing ten pounds or more, animal waste, rocks, bricks, dirt, and tires will not be collected.

    (3)

    All carts and bins shall be kept clean and free of accumulated waste and shall be treated by the producer with an effective insecticide, if necessary, to prevent nuisance.

    (4)

    The producer shall prevent the continued, excessive and unsightly accumulation of refuse upon the property occupied by him or public thoroughfares adjoining his property.

    (5)

    It is a violation of this article to place, or to cause to be placed, excluded waste in any cart, bag, bin, dumpster, or other container for collection.

    (6)

    Inoperative, privately used or worn out household appliances (including refrigerators, stoves, washing machines, dryers, discarded furniture) will not be collected at the curb by the franchisee for the regular fee; however, the franchisee is authorized to charge a fee predetermined by the franchisee and the city. Upon reasonable notice to the franchisee, hot water heaters, mattresses and box springs shall be picked up at the curb at no charge. Producers shall be responsible for removing any chlorofluorocarbons (CFCs) and Freon gas from white goods prior to arranging for collection by franchisee. A tag from a licensed remover shall be prominently displayed on any applicable items prior to collection. The producer must contact the city to request the pick-up by franchisee of any items described in this subsection.

    (7)

    Refuse generated from the conduct of business or commercial enterprise carried on from residential units will be collected at a commercial small business collection rate. Where the structure is the primary dwelling unit occupied by one or more families, incidental commercial activity shall result in residential rates. However, the volume of refuse each week shall not exceed the allowed one 95-gallon cart and five-bag residential limit. All determinations of the rates to be applicable to a residential unit shall be made by the city.

    (8)

    Carts, bins and bags shall be picked up at the curb only. Carts, bins and bags placed in any other location shall not be picked up.

    (9)

    All items placed at the curb on trash pick-up day may be considered refuse and be removed.

    (10)

    Refuse and recyclable items shall be put out by 6:30 a.m. on pick-up days. Carts, bins and bags shall not be placed on the easement in front of the adjoining curb more than 12 hours prior to the regularly scheduled pick-up day. Carts or bins shall not be left on the easement in front of the residential unit adjoining the curb more than 12 hours following the regularly scheduled pick-up day.

    (11)

    Refuse bins and carts must be stored or placed only in the rear yard or inside enclosed structures where they are not visible from the street, with the exception of the regularly scheduled pick-up day hours permitted.

    Exception: Attached townhome /condo unit developments. When unable to store refuse bins and carts in rear yard or enclosed structure due to lack of reasonable access, refuse bins and carts must be stored at the townhome or condo unit dwelling as is physically possible. The area is to be maintained in a clean, trash free and organized state.
