§ 34-60. Downtown parking.

  • (a)

    Designated parking areas for employees of downtown businesses.

    (1)

    All businesses licensed to do business by the city that are located within the downtown area (hereinafter "downtown businesses") shall be eligible to apply to the City Manager annually for parking passes (hereinafter "permits") that will grant a license to the businesses for their employees to park in specific locations on property owned or leased by the city.

    (2)

    Each such parking lot (hereinafter a "restricted parking lot") will be restricted exclusively for the use of employees of the businesses on Jones and South Peachtree Street and shall be prominently marked with signage that specifically identifies each such lot as being restricted parking for permit holders only and that vehicles without permits are subject to being towed.

    (3)

    On or before November 15 of each year, each business shall complete an application on a form designated by the City Manager which shall, at a minimum, identify the business address, and state the number of employees for which such business wishes to assign permits.

    (4)

    The City Manager shall allocate the number of permits to be issued to each business based on the number of permitted parking spaces available, and the number of permits applied for. Each such permit shall be numbered and shall expire on December 31 of the calendar year following the year in which the application was submitted. The City Manager, in his discretion, may extend the time for applications through December 15 of each calendar year for existing businesses and may accept applications out of time and issue additional permits for new businesses in the downtown area.

    (5)

    Upon issuing the annual permits to each business, the City Manager shall, as a condition of granting the permits, provide each business with a certification form for each permit issued and a copy of this downtown parking ordinance [this section 34-60]. Each business shall provide a copy of this downtown parking ordinance to each employee to be issued a permit (hereinafter a "permit holder") and shall require each such person to certify, in writing, that he/she has been provided with a copy of the downtown parking ordinance, and that he/she has read and understands the new parking policy before issuing the permit to the employee. Each business shall retain the original certifications for each permit holder through the calendar year for which such permit is issued.

    (6)

    Each business shall be responsible for maintaining a list of the names, addresses and vehicles of each permit holder. The business shall have sole discretion to determine which employees receive such permits and shall require each permit holder to return the permit to the employer at the conclusion of his/her employment. The business shall have authority to reassign the permit of a former employee to another employee, so long as the business complies with the certification requirement in the paragraph next above.

    (7)

    In the event that a permit is lost or stolen, the business shall apply for a replacement permit from the City Manager upon presentation of a written request for a replacement permit that identifies the lost or stolen permit number. The license to park in the restricted parking lots shall be revoked as to each such lost or stolen permit number.

    (b)

    Designated parking for downtown business customers.

    (1)

    The City Manager shall have authority to designate public parking areas in the downtown area as "customer or visitor parking only."

    (2)

    Each such area designated as "customer or visitor parking only" shall be prominently marked by appropriate signage.

    (3)

    Permit holders shall be required to park in any available restricted parking lot and shall not park in any area designated as "customer or visitor parking only" if there is a space available in a restricted parking lot.

    (4)

    Persons that violate the provisions of this section shall be subject to a penalty as set forth in section 34-80.

    (5)

    The City Manager shall have the authority to restrict access to the restricted parking lots from time to time to accommodate maintenance, repairs and/or special events.
