§ 34-1. Adoption of uniform rules of the road.

  • (a)

    Pursuant to O.C.G.A. § 40-6-370, O.C.G.A. §§ 40-6-1-40-6-395, known as the uniform rules of the road, and the definitions in O.C.G.A. § 40-1-1 are hereby adopted as and for the traffic regulations of the city with like effect as if recited in this chapter.

    (b)

    Unless another penalty is expressly provided by law, every person convicted of a violation of any provision of this section shall be punished according to the provisions of section 1-1, but in no event shall such penalties exceed those provided by state law.

    (c)

    For the purpose of regulating vehicles and traffic in the city, there is hereby adopted the following state and federal regulations:

    1.

    O.C.G.A. § 40-5-140-40-5-159, "Uniform Commercial Driver's License Act,"

    2.

    Parts 382, 383, 390, 391, 392, 393, 395, 396, and 397 of Title 49 of the U.S. Code of Federal Regulations, "The Commercial Motor Vehicle Safety Act of 1986;" and

    3.

    The Federal "Out of Service" Criteria as amended from time to time.

    4.

    O.C.G.A. § 46-7-27, "Rules and Orders;"

    5.

    O.C.G.A. § 46-7-39, "Violations;"

    6.

    O.C.G.A. § 46-11-4, "Hazardous materials violation;"

    7.

    O.C.G.A. § 32-6-1, "Obstruction of, encroachment on, solicitation on, or material injury to public roads;"

    8.

    O.C.G.A. § 32-6-22, "Height of vehicles and loads; automobile carriers;"

    9.

    O.C.G.A. § 32-6-23, "Width of vehicles and loads;"

    10.

    O.C.G.A. § 32-6-30, "General authority of law enforcement officers; penalty for failure to stop for examination; report of violation; consent to stop;"
