§ 26-22. Exemptions.

The following are exempt from the sound level limits of section 26-25:

(1)

Domestic power tools, lawn mowers and agricultural equipment, when operated with a muffler, between the hours of 7:00 a.m. and 10:00 p.m.

(2)

Noises resulting from any authorized emergency vehicles when responding to an emergency.

(3)

Any noise resulting from activities of a temporary duration, for which a special permit has been granted pursuant to this article, and which conforms to the conditions and limits stated thereon.

(4)

Noises from exterior site and building construction activity are exempt from section 26-25 between the hours of 8:00 a.m. and 10:00 p.m. on weekdays and 10:00 a.m. and 8:00 p.m. on Saturdays and holidays. Exterior site and building construction activity may occur on Sundays when the contractor applies for, and is granted, a permit by the Director of Community Development and Planning.

Interior construction activity may take place between the hours of 7:00 a.m. and 10:00 p.m. weekdays and Saturdays. Interior construction may take place between the hours of 10:00 a.m. and 10:00 p.m. on Sunday and Holidays when the Contractor applies for, and is granted, a permit by the Director of Community Development and Planning.

The industrial sound level limit (85 dBA) shall apply in all land use categories.
