§ 101-5. Annexation petition review.

  • (a)

    All petitions for annexation to the city shall conform with those methods prescribed by O.C.G.A. § 36-36-1 et seq. All petitions for annexation shall be submitted first to the Planning and Zoning Board for review. After such meeting, the recommendation of the board shall be forwarded to the Mayor and Council. Failure to submit a recommendation within five days of the review shall be deemed a recommendation of approval. All recommendations are deemed advisory only and shall not bind the Mayor and Council.

    (b)

    The Community Development Director shall notify all adjoining property owners in the city by letter of the time, date and place when such petition shall be acted on by the Mayor and Council.

    (c)

    If a change in zoning or a noncomplying use is proposed for the property to be annexed, then the application must also comply with section 115-314.
